Beth Terrell

Professional Experience

Ms. Terrell is a member of Terrell Marshall & Daudt PLLC (“TMD"), a Seattle law firm. Prior to founding TMD, Ms. Terrell was a member of Tousley Brain Stephens PLLC, where she practiced litigation for twelve years. Ms. Terrell concentrates her practice in complex litigation, including the prosecution of consumer fraud, defective product, securities, and wage and hour class actions. Ms. Terrell has served as co-lead counsel on numerous multi-state and nationwide class actions. Additionally, she has represented individual plaintiffs with employment claims, including race, gender, marital status, and disability discrimination. She has also represented employees in restrictive covenant litigation, successfully resisting numerous injunctions. Ms. Terrell's practice also includes personal injury claims, as well as commercial and construction defect litigation.

Ms. Terrell has successfully tried cases in both state and federal court. In addition to her litigation and trial work, she also counsels small and medium sized companies facing personnel and human resource issues.

Ms. Terrell is a frequent speaker at CLEs on a wide variety of topics, including employment litigation, class actions, securities litigation, easement disputes, and electronic discovery.

Ms. Terrell has been awarded an "AV" rating in Martindale Hubbell by her peers, a rating denoting the highest legal ability and ethical standards. In 2005, she was recognized by Washington Law & Politics magazine as a "Super Lawyer."

Personal Injury and Individual Employment Cases

Perkins v. American Medical Response Ambulance Service, Inc. - Obtained a $400,000 jury verdict for a bus passenger who was seriously injured when an AMR ambulance cut off her bus, causing it to swerve off Interstate 5 and into a ditch.

S.B. v. Nusbaum - Negotiated an $800,000 settlement on behalf of a sexually abused minor.

Discrimination Case Against Fortune 500 Company — Negotiated favorable settlement for African-American manager who had been terminated after 26 years based on false allegations of sexual harassment.

Olson v. Fred Meyer Stores - Obtained a $200,000 jury verdict for a part-time employee whose termination violated the disability protections of the Washington Law Against Discrimination.

Recently Filed Class Actions

Vernon v. Qwest International, Inc. et al. - Co-lead counsel for a proposed class of Qwest internet service customers. The lawsuit seeks to void a $200 "Early Termination Fee" Qwest charges customers who cancel their service before expiration of of a purported term commitment, generally two years. Court v. Tyson Food, Inc. – Plaintiffs counsel representing a proposed class of Washington consumers who purchased Tyson chicken that had been misrepresented as “raised without antibiotics.”

Ramirez v. Precision Drywall, Inc. – Co-lead counsel for a proposed class of hundreds of employees who allege Precision Drywall failed to pay them for overtime work, failed to provide required meal and rest breaks, and forced them to rebate a portion of each paycheck in cash to the company. Taber et al. v. OPT PLLC – Represents a class of female patients who were sexually harassed and abused by a physical therapist.

Frey v. 3PD, Inc. – Represents a proposed class of delivery drivers who are improperly classified as independent contractors. As a result of this misclassification, the employees are denied overtime in violation of Washington’s wage and hour laws.

Wage and Hour Class and Collective Actions

Khadera v. ABM Industries, Inc. – Represents a proposed class of janitors who seek compensation for unpaid overtime and meal and rest break violations.

Barnett et al. v. Wal-Mart Stores, Inc. - Negotiated a $35 million settlement for a class of 80,000 current and former Wal-Mart employees in Washington State alleging violations of Washington's wage and hour laws and the Washington State Consumer Protection Act.

Telecommunications Company Class Action - Negotiated settlement on behalf of hourly paid employees of a major telecommunications company who alleged that their employer failed to provide them with meal and rest breaks, did not pay them for all hours worked, and improperly deducted uniform and tool expenses.

Exempt/Non-exempt Action Against National Communications Company - Obtained certification of a nationwide collective action of current and former employees of a major wireless telecommunication carrier that had been allegedly misclassified as exempt from wage and hour laws. The parties reached a $2 million settlement of the case.

McGinnity v. AutoNation, Inc. - Obtained certification of statewide class of employees seeking recovery of wages owed for paid vacation time. Class Counsel ultimately achieved a seven-figure award for class members in arbitration.

Godfrey v. Chelan County P. U.D. - Obtained certification of a class of 81 employees seeking recovery of wages for unpaid shift-turnover time. Class counsel negotiated a six-figure settlement for the class.

Consumer Class Actions

Odom et al. v. Microsoft, Inc. and Best Buy Stores, Inc. - Co-lead class counsel for a nationwide class of over 300,000 consumers alleging that defendants violated the Washington State Consumer Protection Act when they charged consumers for MSN internet services they never used.

Godoy et al. v. AT&T Wireless Services, Inc. - Co-lead class counsel representing a class comprised of 5 million AT&T Wireless customers alleging that AT&T Wireless engaged in consumer fraud when it failed to pro-rate customers' bills when they terminated their accounts. The class claims ultimately settled for $47 million.

Defective Product Class Actions

In re Nature Guard Cement Roofing Shingles Cases - Co-lead class counsel and trial counsel for a multi-state class of consumers alleging that Nature Guard roofs prematurely fail. The case is currently on appeal.

Splater et al. v. Plasco et al. - Co-lead class counsel for a class of Washington consumers whose homes contain defective Plasco tubing. Negotiated a seven figure settlement on behalf of the class.

Ms. Terrell has also been co-lead class counsel for numerous multi-state and nationwide product defect class actions against companies such as Weyerhaeuser, American Cemwood, Behr, and Hurd Windows, resulting in settlements worth hundreds of millions of dollars to consumers.
